As United Airlines was fueling its jet for lift off, so was a not so discreet passenger on board a flight from New York to Los Angeles. A California teen has filed suit claiming she endured the distress of watching a randy passenger expose and fondle himself while the flight crew did nothing to stop it. 18-year old Monica Amestoy said she was terrified and disgusted and immediately notified a flight attendant when she caught the passenger with his penis exposed.
But as soon as the attendant left, “the perpetrator exposed his penis and started to masturbate again,” Amestoy’s complaint states.
The flight attendant told her there were no available seats in her class and despite repeated complaints, the flight crew did nothing to relieve Amestoy’s discomfort. The man remained seated near her and continued exposing himself for the entire duration of the six-hour flight.
Amestoy also claims that the flight crew allowed the offender to leave without alerting police, and the airline never contacted the authorities to report the passenger’s behavior. Upon her arrival in Los Angeles, Amestoy’s father contacted police.
The male passenger was later arrested and convicted for lewd in-flight behavior.
Amestoy’s attorney, Gloria Allred, said that their goal in filing the lawsuit is to force United to put a clear policy in place that would protect their passengers going forward. The lawsuit accuses the company of negligence, intentional infliction of emotional distress and false imprisonment, and seeks unspecified compensatory and punitive damages.
In response to the suit, the airline said in a statement: ‘The comfort and security of our customers is our top priority, and we will closely review this complaint when we receive it.’
I think the biggest problem United may have with this lawsuit is its failure to alert authorities about the passenger’s behavior. At very least there was a duty to report a crime onboard a flight. When the passenger exposed himself in public, he was violating the law. Had the passenger committed a crime of violence, undoubtedly the flight crew would have reported that.
Not relocating Amestoy is also damaging, especially if there were available seats on the flight, not just available seats in the class Ms. Ametoy was seated.
The lawsuit on its face seems viable, although Allred’s claim that its motivated by noble intent is thinly veiled. A demand for punitive damages says otherwise. They’re going after United for a big payoff.
